BOOKING TERMS & CONDITIONS
AND PAYMENT POLICY FOR EXCLUSIVE BOAT CHARTER OF “BLAKJAK”

1. Booking Confirmation:

To secure your exclusive boat charter of the 2020 43ft Midnight Express “Blak Jak,” a 100% deposit of the total charter fee is required at the time of booking.  50% of this amount is made immediately non-refundable.

2. Payment Methods:

Payment for the charter of the 2020 43ft Midnight Express “Blak Jak” can be made in USD (United States Dollars). However, locally based charter guests have the option to pay in BSD (Bahamian Dollars) if they prefer.

Credit Card:
We accept payments through major credit cards, including Visa, MasterCard, and American Express, in USD and BSD.

Bank Wire:
If you choose to make payment via bank wire, proof of funds must be provided once the wire transfer is initiated to confirm the booking. Please note that bank wires require a 48-hour clearance time frame for the booking to be considered confirmed.

All payments must be made in the specified currency (USD or BSD) based on your preference.

3. Cancellation Policy:

We have a strict cancellation policy due to the exclusivity of the charter. Cancellations made:

• 30 days or more prior to the charter date with proper notice via email only: 50% of the deposit is refundable.

• Less than 30 days prior to the charter date: The deposit is non-refundable.

4. Rescheduling:

Rescheduling the charter may be possible if done at least 14 days before the original charter date and is subject to availability. Rescheduling may incur additional charges if the new date involves higher fees.

5. Weather Conditions:

The captain of “Blak Jak” reserves the right to postpone or cancel the charter in case of adverse weather conditions, which may jeopardize the safety of the passengers. In such cases, a full refund or rescheduling without additional charges will be offered.

6. Damages and Additional Costs:

In addition to the charter fee, a refundable security deposit of $2,000 will be held. This security deposit is intended to cover any damages or losses incurred to the vessel “Blak Jak,” equipment, or any part of the boat during the charter. If no damages or losses occur, the security deposit will be refunded in full within 14 days of the date of the charter, provided that all items are found to be in good order.

7. Safety Regulations:

Passengers must adhere to the safety regulations and instructions provided by the captain and crew of “Blak Jak.” Failure to do so may result in the termination of the charter without refund.

8. Liability:

a. Personal Injury:
The charter operator prioritizes the safety and well-being of passengers. While every effort is made to ensure a safe experience, the client acknowledges that engaging in activities such as snorkeling, swimming, and any off-boat trips involves inherent risks. By participating in these activities, the client assumes full responsibility for their safety and any potential personal injury. The charter operator, captain, and crew of “Blak Jak” are not liable for any personal injuries sustained during these activities.

b. Snorkeling and Water Activities:
Snorkeling, swimming, and other water-based activities involve inherent risks associated with water conditions, marine life, and the individual’s swimming ability. Clients are expected to follow safety guidelines and instructions provided by the captain and crew. Any personal injuries, accidents, or encounters with marine life during these activities are at the client’s own risk, and the charter operator assumes no liability.

c. Falls and Accidents:
While on board “Blak Jak,” clients are urged to exercise caution when moving about the vessel, especially in adverse weather conditions. The charter operator is not liable for any accidents, falls, or injuries that may occur on the vessel. Clients are advised to adhere to safety regulations and follow the captain’s guidance at all times to minimize such risks.

d. Use of Equipment:
Clients are responsible for using any provided equipment, such as snorkeling gear, with care. Any personal injury or accidents resulting from the misuse or malfunction of equipment are the client’s responsibility.

e. Off-Boat Trips: 
In the event of off-boat trips, clients are expected to follow any safety guidelines and instructions provided by the captain and crew. The charter operator is not liable for any personal injuries, accidents, or incidents that may occur during these trips. Clients participate at their own risk and responsibility.

9. Maximum Passenger Limit:

 “Blak Jak” has a maximum passenger limit of 12 passengers. No more than 12 passengers may board the vessel for safety reasons. 

 Children under the age of 21 may be accommodated but will require specific approval from the charter operator in advance to proceed on the trip. The charter operator will assess the suitability of including children in the charter to ensure their safety and compliance with relevant regulations.

10. Trip Postponement and Forfeiture of Payment:

Should the charter clients wish to postpone their trip, they may do so with the understanding that the charter operator reserves the right to assess the feasibility of the trip. The captain of “Blak Jak” is the final authority in determining whether the trip can proceed safely. If the captain deems the trip undoable and the client decides not to proceed with the charter, the client will forfeit all payment made for the vessel.

11. Maintenance and Breakdown:

While every effort will be made to ensure the vessel “Blak Jak” is in proper working order, unforeseen maintenance issues or breakdowns may occur. In the event of mechanical or equipment breakdowns that affect the charter, the charter operator will make reasonable efforts to address the issue promptly. 

If a breakdown occurs before or during the charter, the charter operator will, at their discretion, either provide an alternative vessel for the charter or reschedule the charter to a later date without additional charges, subject to availability.

If no alternative vessel is available or the charter clients choose not to reschedule, a pro-rata refund based on the time lost due to the breakdown will be provided.

The charter operator is not liable for any additional expenses or losses incurred by the charter clients due to maintenance issues or breakdowns beyond the charter fee paid for the vessel.
